Court Hands Prop. 15 Opponents Defeat, Striking Down Significant Portions of Ballot Arguments

Updated: Aug 24, 2020

Court deemed "false or misleading" scare tactics that homeowners and home-based businesses would be affected, and that Prop. 15 has no accountability

Court ordered more than 100 words to be deleted from opposition’s arguments

The courts just dealt another devastating legal blow to opponents of Prop. 15, striking down some of the main scare tactics they’ve been using throughout this campaign. The rulings, which addressed ballot language lawsuits brought by proponents and opponents of Prop. 15, resulted more than 100 words getting struck from opponents’ ballot language and 1 word getting struck from proponents’ ballot language.

“We’re very encouraged with the court’s tentative ruling striking down significant portions of the opposition’s false arguments against Prop. 15. The court’s ruling today is concrete evidence that there are consequences for running a campaign based solely on debunked scare tactics. They made a significant tactical error in putting all their eggs in a basket of lies. Opponents should immediately delete these statements from their website and all campaign materials.” – Alex Stack, Yes on 15 Communications Director

Below are opponents’ three arguments that the court deemed false or misleading:

1.) “Prop 15 lets the legislature raise property taxes on homeowners” ENTIRE PARAGRAPH DELETED

According to the court, opponents' entire paragraph claiming that Prop. 15 would allow the legislature to raise taxes on homeowners is "false and/or misleading" and must be deleted entirely (page 3):

2.) “Prop 15 allows state politicians to raise property taxes on millions of home-based businesses” – DELETED

According to the court, opponents’ arguments that Prop. 15 would allow state politicians to raise property taxes on homeowners is "false and/or misleading," and must be deleted (pages 3-4):

3.) “There’s no accountability how the money is spent” – DELETED
